"Permission denied" is not a "bug". It doesn't mean you're doing something "wrong". It means exactly what it says, no more, no less -- you do really, genuinely, do not have permission to create files there.
Most things do not, cannot, and should not create files inside root. I doubt your backup system is an exception.

I am trying to tidy our server and write cron to keep it tidy.
We took on a third party to do some work last year. They were given their own UID/pwd so that they would have limited access. Part of what they wrote created an archive file at the end of every day.

backup - backup or archive file system
SYNOPSIS

DESCRIPTION
The command uses find(1) and cpio(1) to save a archive of all files that have been modified since the modification time of on the default
