Can you check with mount command then if exit code is 0 do the rsync, else don't rsync ?
Touching a file will work on both directory and mountpoint so that check is not good.

Something like
Code:
mount | grep "/your/mountpoint"
if [ $? -eq 0 ]; then
echo "will rsync"
else
echo "will not rsync, unable to find mountpoint"
fi

hvmount - Mount or umount device through HAL SYNOPSIS
hvmount COMMAND ARGS [options] hvumount [options] <-c | -r> <-a | mountpoint | device | udi> DESCRIPTION
hvmount Umount the mountpoint, device, or udi given on the command line, or all mounted devices. Alternatively (and additionaly), device, udi and mountpoint may be given using options -p, -d or -u. COMMANDS
mount device udi mount device which has udi. register mountpoint udi register mountpoint for udi. umount unmount device, mountpoint or udi. list list mounted and registered devices. umountpoint udi unregister mountpoint for udi. remove udi remove completly udi. clean remove database. OPTIONS
