You can shortend a bit..
Try this one,

awk 'BEGIN{FS=OFS="|";}{if(a[$1] !~ $2&&a[$1]){a[$1]=a[$1]","$2;}if(!a[$1]){a[$1]=$2;}}END{for(i in a){print i,a[i];}}' file

a[$1] - its an array and using the first column as an index..
