Do you now have to pay to download the Solaris 8 OE? If so when did they change it?

Yes, You have to pay to download Solaris 8. I believe you can download Solaris 9(SPARC) FREE.

I couldn't find any free Solaris OE for Intel. But you might find different flavour of Unix!!
